The Conveyancing Process
If you have made the decision to buy a house, it’s essential you seek advice from a qualified professional. Whether it’s your first time or not, this will benefit you in understanding your financial position and what is involved in the conveyancing process. It’s easy to feel intimidated at this stage, so a specialist property solicitor can help you understand what is required from you and at which stage. The purchasing process is fairly straightforward, but can differ depending on the property you are purchasing. However, generally speaking, the conveyancing process follows the same timeline:
1. Pre-Contract
Once you’ve found your perfect property and had your offer accepted, your chosen conveyancing solicitor will begin carrying out the legal work that is required before contracts can be exchanged. The seller’s solicitor will provide us with information regarding the property, including evidence of their legal ownership.. We will then review these documents, raising enquiries if need be, until we are satisfied with the results and will also carry out property searches with the Local Authority, water authority and other relevant agencies. Meanwhile, it’s essential to get your finances in order and have your mortgage offer accepted, ready for the exchange. Once all searches have been carried out, all enquiries answered and your mortgage in place, you will be ready to exchange.
2. Contract Exchange
As your chosen conveyancing solicitors, we will be responsible for ensuring the exchange happens smoothly. Once Contracts are exchanged you will be legally committed to your sale or purchase and it is at this stage that your completion date is agreed. Following exchange we will ask your mortgage lender to release the funds, allowing us to transfer the balance to the seller’s solicitor on the day of completion.
3. Completion
You’re almost done and you can get ready to move in! On the completion day we will arrange for the funds transfer to take place and you can pick up your keys once the funds have changed hands. Following completion the final steps involve paying the Stamp Duty & Land Tax due for the property, which we will transfer on your behalf. Then, we will make an application to the Land Registry, confirming your legal ownership of the property.
With Pickering & Butters’ conveyancing solicitors on your side and our wealth of experience, you can rest assured we'll make sure things run as smoothly as possible.
